Lawyers Leaving Nevada

Victims of medical malpractice in Nevada are finding that it’s getting harder and harder to find a lawyer to represent them. Limits on verdicts and caps on attorney fees are making it unprofitable to practice. This according to a Physicians and Medical Malpractice Insurance website.

Apparently the Nevada legislature passed an incredibly low limit of $325,000 for pain and suffering damages. That, coupled with juries who have been fed a bunch of propaganda, has resulted in more and more defense wins.

According to the website:

Trial lawyers blame the 2004 initiative, which made trying cases much less lucrative. Passage of Question 3 limited fees to 40 percent of the first $50,000 of any award, one-third of the next $50,000, a quarter of the next $500,000 and 15 percent of any amount over $600,000.

Note from Virginia Medical Malpractice Attorney Ben Glass: I’ve represented a fair number of doctors when they, or someone in their family have been hurt by medical negligence. While they undoubtedly cheered the passage of laws like those in Nevada, they always whistled a different tune when it came to their families suffering.

It will be interesting to see if the changes to the the medical malpractice laws affect insurance rates… After all, that’s the reason for limiting damages, isn’t it?
